Terms of Service

BentBox Folio ("Folio", "we", "us") is a portfolio platform for photographers and visual artists to publish, organise, and share non-adult photographic and visual work. By creating an account or uploading content, you agree to these Terms of Service. If you do not agree, please do not use Folio.

1. Who we are

Folio (folio.bentbox.co) is a service operated by Haas & Reed B.V., a private company (besloten vennootschap) incorporated in the Netherlands, with registered office at Mantelmeeuwhof 15, 3582DN Utrecht, and registered with the Dutch Chamber of Commerce (KvK) under number 68817940. "BentBox" and "BentBox Folio" are trading names of Haas & Reed B.V. References to "we", "us", and "our" in these Terms mean Haas & Reed B.V.

Folio is a separate, non-adult environment from any other BentBox property and is intended solely for portfolio-quality photographic and visual work that does not depict nudity, sexual activity, or sexually suggestive content.

2. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is higher), to create an account and upload content. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

You agree to provide accurate information when registering and to keep your account information up to date. We may refuse, suspend, or terminate accounts at our discretion, including where we believe an account has been used to violate these Terms.

3. Content policy & non-adult rule

Folio is a 100% non-adult platform. You may not upload, link to, or otherwise distribute through Folio any content that contains:

  • nudity, partial nudity in a sexual context, or visible genitalia;
  • sexually explicit, pornographic, or sexually suggestive imagery;
  • sexualised depictions of any person, regardless of how they are framed or described;
  • fetish content, BDSM imagery, or sex-work-adjacent material; or
  • content that links to, advertises, or drives traffic to adult platforms or paywalls.

Tasteful fine-art nude work that would be acceptable on other BentBox properties is not acceptable on Folio. If you want to publish that kind of work, please use the appropriate BentBox product instead.

4. Your content & rights you grant us

You retain all ownership rights in the photographs, images, text, and other materials you upload to Folio ("Your Content"). We do not claim ownership of Your Content.

By uploading Your Content, you grant Folio a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display, distribute, resize, transcode, and otherwise process Your Content for the limited purpose of operating, providing, promoting, and improving the Folio service. This includes generating thumbnails, optimised renditions, social-media preview images, and search-engine previews. The licence ends when you remove Your Content from Folio, except that we may retain backup copies for a reasonable period and may retain copies that have already been shared by other users or indexed by third parties beyond our control.

5. Releases, warranties & depicted persons

When you upload Your Content, you warrant and represent that:

  • you are the author of Your Content, or you have all necessary rights, licences, and permissions to upload and publish it on Folio;
  • Your Content does not infringe any copyright, trademark, trade secret, moral right, or other intellectual-property right of any third party;
  • where Your Content depicts identifiable people, you have obtained any model releases, consents, or permissions required by law in the jurisdictions where you photographed and where you publish;
  • where Your Content depicts identifiable private property, locations, artworks, or branded items that require a release, you have obtained the necessary property releases or permissions;
  • publication of Your Content on Folio does not violate any contract, court order, or law applicable to you or to depicted persons.

Responsibility for releases sits with you, the uploader. Folio does not require you to upload model or property release forms, and we do not review or verify them. You agree to keep your own records of any releases for as long as needed under applicable law.

6. Content depicting minors

Folio takes content depicting minors (anyone under 18, or under the age of majority in their jurisdiction) seriously, even when that content is fully clothed and entirely non-sexual.

If Your Content depicts a minor, you additionally warrant that:

  • you have written consent from the minor's parent or legal guardian to photograph the minor and to publish the resulting images on Folio;
  • the content is non-sexual, non-suggestive, and would be considered appropriate for a general audience;
  • the content does not reveal information that could be used to identify, locate, or contact the minor (such as school name, home address, or full name combined with other identifying details), unless the parent or guardian has expressly consented to that disclosure;
  • you will provide a copy of the relevant consent on request from Folio, and you will remove the content promptly if the parent or guardian withdraws consent.

Any sexualised, suggestive, or exploitative depiction of a minor is strictly prohibited and will be reported to the appropriate authorities. We cooperate with law-enforcement requests in this area without exception.

7. Prohibited conduct

You agree not to use Folio to:

  • upload content that violates Section 3 (non-adult rule) or Section 6 (minors);
  • upload content that is unlawful, defamatory, harassing, threatening, hateful, or that incites violence or discrimination;
  • upload content depicting an identifiable person without the rights and permissions described in Section 5;
  • impersonate another person, photographer, or brand, or misrepresent your affiliation with anyone;
  • scrape, crawl, or harvest content or user data from Folio other than as expressly permitted;
  • circumvent any security, access-control, or rate-limiting mechanism;
  • upload malware, run automated bots, or otherwise interfere with the operation of the service;
  • resell, sublicense, or commercially exploit Folio itself (as opposed to Your Content) without our written permission.

8. Takedowns, complaints & copyright (DMCA)

8.1 Depicted persons & right-of-image complaints

If you appear in content published on Folio and you did not consent to that publication, or you have withdrawn your consent, you can request removal by emailing legal@bentbox.co with:

  • the URL(s) of the content you want removed;
  • a description of how you appear in the content (so we can identify you);
  • a statement that you are the depicted person, or the parent/legal guardian of a depicted minor, and that you do not consent (or no longer consent) to publication;
  • your contact details.

We will review good-faith requests promptly and remove or restrict access to content where appropriate. We may contact the uploader for context but we will not share your details with them without your permission.

8.2 Copyright (DMCA & equivalents)

If you believe content on Folio infringes your copyright, send a notice to legal@bentbox.co that includes:

  • identification of the copyrighted work you claim has been infringed;
  • identification of the allegedly infringing material on Folio (URLs);
  • your contact information (name, address, email, phone);
  • a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner of the copyright or authorised to act on the owner's behalf;
  • your physical or electronic signature.

We will respond to valid notices in accordance with the U.S. Digital Millennium Copyright Act and comparable laws elsewhere. We may terminate the accounts of users who repeatedly infringe copyright.

9. Enforcement, suspension & termination

We may, at our sole discretion and without prior notice, remove content, restrict features, suspend accounts, or terminate access to Folio if we believe a user has violated these Terms, applicable law, or the rights of others. Where reasonable, we will notify the affected user and explain the reason. For serious violations — including content depicting minors in a sexual context, threats of violence, or coordinated abuse — we will act immediately.

10. Disclaimers

Folio is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that Folio will be error-free, that defects will be corrected, or that the service or its servers are free of harmful components.

We do not endorse, monitor, or vouch for content uploaded by users. Any reliance you place on user-uploaded content is at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, BentBox, Folio, and our officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of Folio, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or in connection with Folio is limited to the greater of (a) the amount you paid us, if any, in the twelve months preceding the event giving rise to the claim, or (b) one hundred euros (€100). Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable Dutch law.

12. Indemnification

You agree to defend, indemnify, and hold harmless BentBox, Folio, and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your Content, including any claim that Your Content infringes intellectual-property rights or violates the rights of any depicted person;
  • your breach of these Terms or of any warranty you have given (in particular the warranties in Section 5 and Section 6);
  • your violation of any applicable law or regulation;
  • your use of Folio in a way that is not authorised by these Terms.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify users by email or through the Folio interface. Continued use of Folio after changes take effect means you accept the updated Terms.

14. Governing law & disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods. Any dispute arising out of or in connection with these Terms or your use of Folio will be subject to the exclusive jurisdiction of the competent courts of Midden-Nederland (Utrecht), the Netherlands, except where mandatory consumer-protection laws of your country of residence give you the right to bring proceedings in your local courts.

If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not, however, obliged to participate in any out-of-court dispute resolution before a consumer arbitration board.
